Niniejszy dokument prawny został sporządzony w języku francuskim zgodnie z obowiązującym prawem francuskim.

Article 1 — Purpose

These Terms of Sale (hereinafter "Terms") govern the sale of subscriptions to the SentryAlert mobile application, published by EI ROMAIN COUZON.

Any subscription to SentryAlert implies full and complete acceptance of these Terms. The User acknowledges having read them before any subscription.

Article 3 — Service Description

SentryAlert is a mobile application (iOS and Android) providing real-time push notifications when a Sentry Mode event is detected on a compatible Tesla vehicle.

The service includes:

  • Receiving events via the Tesla Fleet Telemetry protocol;
  • Sending push notifications via the Apple Push Notification service (APNs) on iOS and Firebase Cloud Messaging (FCM) on Android;
  • A real-time monitoring dashboard;
  • A Sentry Mode event history;
  • Remote vehicle actions (lock, honk, flash headlights, etc.).

Technical requirements:

  • A Tesla vehicle compatible with Fleet Telemetry;
  • An iPhone running iOS 17 or later, or an Android device running Android 8.0 or later;
  • An active Internet connection (Wi-Fi or mobile data).

Article 4 — Subscriptions and Pricing

4.1 — Available Plans

SentryAlert offers the following subscription plans, all prices including taxes:

Prices are shown including all applicable taxes. They may vary depending on the User's country of residence, in accordance with Apple's (iOS) or Google Play's (Android) pricing policy.

4.2 — Free Trial

A 7-day free trial is offered for all paid plans (Solo, Duo, Garage). The trial is limited to one use per Apple or Google account. At the end of the trial period, the subscription is automatically activated and billed, unless previously canceled by the User.

4.3 — Billing

Subscription billing is managed exclusively by the distribution platform:

  • On iOS: by Apple via the App Store.
  • On Android: by Google via the Google Play Store.

EI ROMAIN COUZON does not have access to the User's payment information. Payment, renewal and refund conditions are subject to Apple's (iOS) or Google's (Android) general terms and conditions.

Article 5 — Plan Changes

  • Upgrade: Switching to a higher plan takes effect immediately. Apple (iOS) or Google Play (Android) applies a prorated charge for the remaining period of the current subscription.
  • Downgrade: Switching to a lower plan takes effect at the beginning of the next renewal period.

Article 6 — Right of Withdrawal and Cancellation

6.1 — Right of Withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium whose performance has begun with the consumer's agreement. By subscribing to SentryAlert, the User expressly acknowledges and agrees to waive their right of withdrawal from the start of use of the service.

6.2 — Cancellation

The User may cancel their subscription at any time:

  • On iOS: Settings > [your name] > Subscriptions.
  • On Android: Google Play Store > Menu > Payments & subscriptions > Subscriptions.

Cancellation takes effect at the end of the current billing period. The User retains access to the service until the end of the already paid period.

6.3 — Refunds

Any refund request must be addressed directly to the distribution platform:

Article 7 — Best Efforts Obligation

EI ROMAIN COUZON commits to using its best efforts to ensure the proper functioning of the SentryAlert service. This constitutes a best efforts obligation and not a guarantee of results.

The 3-second notification latency target is a performance goal and not a contractual guarantee. Actual latency may vary depending on factors beyond the Publisher's control (network, Tesla infrastructure, Apple or Google servers, etc.).

Article 8 — Limitation of Liability

EI ROMAIN COUZON shall not be held liable in the event of:

  • Interruption or malfunction of Tesla services, the Tesla API or the Fleet Telemetry protocol;
  • Interruption or malfunction of Apple services (App Store, APNs) or Google services (Google Play Store, FCM);
  • Failure of the User's Internet connection;
  • Modification, restriction or removal of the Tesla API or Fleet Telemetry features by Tesla, Inc.;
  • Unavailability of Sentry Mode on the User's vehicle;
  • False positives or undetected events;
  • Non-compliant use of the service by the User.

SentryAlert is a complementary information service and does not constitute a security system, alarm system or surveillance device in any way. It cannot substitute for a professional security system or law enforcement.

Article 9 — Intellectual Property

All elements composing the SentryAlert application and the sentryalert.app website (texts, images, graphics, logo, icons, source code, database) are the exclusive property of EI ROMAIN COUZON, unless otherwise stated.

Subscribing grants the User a personal, non-exclusive, non-transferable and non-assignable right of use, limited to the duration of the subscription. Any reproduction, representation, modification or distribution, in whole or in part, is prohibited without prior written authorization.

Article 10 — Personal Data

The processing of the User's personal data is described in the Privacy Policy, available at: Privacy Policy.

The User has rights of access, rectification, deletion and portability of their data, in accordance with the General Data Protection Regulation (GDPR). To exercise these rights, the User may contact the Publisher at: contact@sentryalert.app.

Article 11 — Applicable Law and Dispute Resolution

These Terms are governed by French law.

In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action.

In accordance with Articles L.611-1 et seq. of the French Consumer Code, the User may use the following free mediation service:

Competent jurisdiction: Court of Montpellier.

The User may also submit their complaint on the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

Article 12 — Modification of Terms

EI ROMAIN COUZON reserves the right to modify these Terms at any time. Users will be notified of any substantial changes via a notification within the application.

Continued use of the service after notification constitutes acceptance of the new Terms.
